These Terms of Use ("Terms") govern access to and use of the MySociety software platform, websites, mobile experiences, and related services (collectively, the "Service") operated by Digital Creatings Private Limited ("Digital Creatings", "we", "us", or "our"), a company incorporated in India. By registering a society, creating an account, or otherwise using the Service, you agree to these Terms and our Privacy Policy.
1. Definitions
- Society means a housing society, apartment association, gated community, or similar residential organization registered on MySociety.
- Society Administrator means the person or persons authorized to manage the Society's MySociety workspace, billing, and settings.
- User means any individual with an account on the Service, including society administrators, supervisors, security staff, and residents.
- Customer Data means information entered or uploaded by or on behalf of a Society, including resident records, gate logs, financial data, documents, and communications.
- Subscription means the paid (or promotional) access period for a Society's use of the Service.
2. The Service
MySociety is a cloud-based, multi-tenant software platform for residential society management in India. Features may include, without limitation:
- Gate entry, visitor, and delivery logging
- Maintenance billing, collections, and receipts
- Expense tracking and reporting
- Complaint and SOS workflows
- Society notices and announcements
- Resident, supervisor, guard, and admin portals
- Push notifications, email, and WhatsApp messaging (where enabled)
We may add, modify, or discontinue features with reasonable notice where practicable. The Service is provided on a subscription basis per Society, not per individual resident.
3. Eligibility and account registration
Society registration must be completed by a person authorized to act on behalf of the Society (for example, a committee member, secretary, or treasurer). You represent that the information you provide during registration is accurate and that you have authority to bind the Society to these Terms.
Residents may register through a Society's invitation or self-registration workflow, subject to approval by the Society Administrator. Each User must provide accurate account information and maintain the confidentiality of login credentials. You are responsible for all activity under your account.
You must be at least 18 years of age to create an account, or use the Service under supervision of a parent or legal guardian where permitted by applicable law.
4. Subscription, fees, and billing
Standard pricing
The standard subscription fee is ₹5,999 per Society per month, unless a promotional rate applies. Pricing is subject to change with notice on our website or by email to the Society Administrator before renewal.
Launch promotional offer
From time to time, we may offer a launch promotion for the first 100 Societies, which may include 3 months of complimentary access and a reduced monthly rate of ₹1,999/month (instead of ₹5,999/month), subject to spot availability and the terms displayed at registration. Promotional benefits apply only while the Society remains eligible and in good standing.
Payment and renewal
Unless otherwise stated during registration, subscriptions are billed monthly in Indian Rupees (INR). Societies may pay by methods we support (such as UPI, cash, or cheque) as indicated during onboarding. Failure to pay may result in suspension after any applicable grace period.
Grace period
After subscription expiry, Societies may receive a grace period of up to 30 days with continued access, after which features may be restricted until payment is received.
Taxes
Fees are exclusive of applicable taxes (including GST, where applicable), which shall be borne by the Society unless stated otherwise.
5. Society Administrator responsibilities
Society Administrators are responsible for:
- Maintaining accurate Society profile, flat, and resident information
- Approving or rejecting resident registrations and role assignments
- Ensuring use of the Service complies with applicable housing society laws, bye-laws, and regulations
- Obtaining any consents required from residents before uploading their personal data
- Responding to resident requests regarding data held in the Society's workspace
- Promptly notifying us of unauthorized access or security incidents
For most resident personal data processed through MySociety, the Society acts as the data controller and Digital Creatings acts as a data processor providing the platform. See our Privacy Policy for details.
6. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes
- Access or attempt to access another Society's data or accounts without authorization
- Reverse engineer, scrape, or overload the Service except as permitted by law
- Upload malware, unlawful content, or material that infringes third-party rights
- Impersonate another person or misrepresent your affiliation with a Society
- Circumvent security, tenant isolation, or usage limits
- Resell or sublicense the Service without our written consent
We may investigate violations and suspend or terminate access where necessary to protect the Service, other customers, or comply with law.
7. Customer Data and privacy
As between you and Digital Creatings, the Society retains ownership of Customer Data. You grant us a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Service, as described in our Privacy Policy.
You are responsible for the accuracy, quality, and legality of Customer Data and for ensuring you have the right to provide it to us.
8. Storage and document limits
Each Society receives up to 5 GB of document and file storage unless a different limit is agreed in writing. We may enforce storage limits and request removal of excess content. Backup and export features, where available, should be used for important Society records.
9. Communications and notifications
The Service may send notifications via push (Firebase Cloud Messaging), email, SMS, or WhatsApp (Meta Cloud API) based on settings configured by the Society or User. Message delivery depends on third-party networks and devices. Standard carrier or data charges may apply to Users.
By using notification features, you consent to receiving operational messages related to the Service. Marketing messages, if any, will be sent in accordance with applicable law.
10. Intellectual property
The Service, including software, design, trademarks, and documentation, is owned by Digital Creatings or its licensors. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, or create derivative works except as expressly permitted.
Feedback you provide may be used by us without obligation or compensation.
11. Confidentiality and security
We implement reasonable technical and organizational measures to protect the Service, including tenant isolation, role-based access controls, password hashing, and audit logging. No system is completely secure; you acknowledge inherent risks of internet-based services.
12. Service availability and support
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, upgrades, or events beyond our reasonable control (including internet or cloud provider outages) may cause temporary unavailability.

13. Term and termination
These Terms remain in effect while you use the Service. A Society may stop using the Service by not renewing its Subscription. We may suspend or terminate access for material breach, non-payment, legal requirement, or prolonged inactivity, with notice where reasonable.
Upon termination, access to the Society workspace may be disabled. We may retain Customer Data for a limited period as described in our Privacy Policy or as required by law. Societies should export required records before termination where export tools are available.
14. Disclaimers
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law. We do not warrant that the Service will meet every operational requirement of your Society or that maintenance calculations, reports, or notices will be legally sufficient without your independent verification.
MySociety is a software tool. Society committees remain responsible for financial, legal, and operational decisions made using the platform.
15. Limitation of liability
To the maximum extent permitted by applicable law, Digital Creatings shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from or related to the Service or these Terms.
Our aggregate liability for any claims arising out of or relating to the Service shall not exceed the total fees paid by the Society to us in the twelve (12) months preceding the event giving rise to the claim, or ₹10,000, whichever is greater, except where liability cannot be limited under applicable law.
16. Indemnification
You agree to indemnify and hold harmless Digital Creatings, its directors, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, violation of these Terms, or violation of applicable law, except to the extent caused by our gross negligence or wilful misconduct.
17. Governing law and disputes
These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction over disputes arising from these Terms or the Service, subject to any mandatory consumer protection provisions that apply to you.

18. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and notify us to close your Society account.
19. General
- Entire agreement: These Terms, together with the Privacy Policy and any order or registration details, constitute the entire agreement regarding the Service.
- Severability: If any provision is held invalid, the remaining provisions remain in effect.
- Assignment: You may not assign these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
- No waiver: Failure to enforce a provision is not a waiver of future enforcement.
